1. Learned counsel appearing on behalf of the petitioners submits as follows. The petitioners had a long standing civil dispute with the de-facto complainant. Out of such grudge, the petitioners have been falsely implicated in this case. No grievous injury was received by anyone.
2. Learned counsel appearing on behalf of the State relies on the case diary and strongly opposes the prayer for anticipatory bail. He relies on the statement of the victim as well as the statements of witnesses, which implicate the present petitioners. Although the injury reports do not show infliction of any grievous injury, there is a seizure list for burnt articles as the house was set on fire and certain valuable articles were stolen.
3. Considering the above, the other materials available in the case diary and the fact that the petitioner no. 5 is a
female member of the household, while I am inclined to grant anticipatory bail so far as the petitioner no. 5 (Shyamali Dalapati) is concerned, the application for anticipatory bail of the petitioner nos. 1, 2, 3 and 4 is rejected.

In the event of arrest, the petitioner no. 5 shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to further conditions that the said petitioner shall cooperate with the investigation and shall not threaten or intimidate the witnesses.
5. Accordingly, the application for anticipatory bail is allowed-in-part.
6. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
