Mr. Suddhadev Adak ......For the Petitioner Ms. Chaitali Bhattacharyya Mr. Mrinal Kanti Biswas .....For the State The grievance of the writ petitioner who is the wife of the deceased teacher is that her husband was never given the appropriate scale of pay as was directed by the Assistant Secretary of School Education Department which appears from page 23 of the writ application and also that she is not getting the family pension. In this regard the petitioner filed one representation dated 18.12.2020 which is at page 36 of the writ application.

Bhattacharyya submits that in this matter there is a letter of the deceased teacher which refers to some papers relating to option of pension including family pension-cum-gratuity dated 10.08.1985 by retired Headmaster Mr. Kanai Samanta.

In these circumstances I direct the concerned District Inspector of Schools (S. E.), Chandannagar

Sub-division being the Respondent No.3 to give a hearing to the petitioner and also to the school and the school is directed to produce all papers relating to the petitioner's husband as has been referred in the letter of the deceased teacher dated 26.08.2011. The hearing is to be given by six weeks from the date of communication of this order, if necessary, further hearing and further scope to the school to be given to produce the papers referred in the letter of the deceased teacher dated 26.08.2011 as it is an old case. However, the entire thing is to be completed by twelve weeks from the date of communication of this order. After the entire exercise is over by twelve weeks from date, the decision is to be communicated by the District Inspector of Schools within a period of three weeks after the expiry of the said twelve weeks' period.

With this direction the writ application is disposed of.
