1. In this writ petition the petitioner has prayed for notional fixation of his pay with effect from 1st January, 2002 and payment of arrear salary from 1st February, 2002 to 22nd December, 2010.

2. The petitioner has also prayed for re-fixation of his salary as on 23rd December, 2010, in considering of his notional fixation of pay from 1st February, 2002 and re-fixation of his pension accordingly.

3. Mr. Ghosh has appeared for the petitioner and Mr. Ghosh has submitted that as per report of Special Officer dated 19th February, 2004, the petitioner would be entitled for the relief as prayed for in this writ petition. He has also referred to the approval order of the petitioner dated 15th February, 2011 by dint of which the petitioner's approval has been granted with effect from 23rd December, 2010, as per the Court's order.

4. Mr. Ghosh says that petitioner's prayer as above may be duly considered by the respondent authority.

5. Mr. Dey, learned advocate has appeared for the State respondent.

6. Considering the prayer of the petitioner, it is found proper to dispose of the instant writ petition by directing the respondent no. 2/the Commissioner of School Education, West Bengal to treat the instant writ petition as the representation of the writ petitioner and decide thereupon, by dint of a reasoned order.

7. In doing so, the respondent no. 2 shall afford opportunity of hearing to the petitioner and deliver his order within a period of eight weeks from the date of communication of copy of this order.

8. The writ petition as above, is disposed of.

9. Since no affidavit is called for in this case, the allegations made in the writ petition, are deemed to have been denied by the respondents.

10. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
