The instant revisional application has been filed for quashing of the proceeding being Pursurah Police Station Case No. 39 dated 26.03.2010 under Section 147/148/149/448/325/427/379/354/302/506 of the Indian Penal Code 25/27 of the Arms Act 9(b) (ii) of the I.E. Act arising act of G.R. Case No. 224/2010.

Perused the complaint and the materials on record which stated that the victim was attacked by a group of 50 to 60 persons armed with deadly weapons and had been brutally assulted who expired on the spot. The eye-witnesses supposedly had revealed the presence of the petitioners in the alleged offence which required assessment of evidence to be recorded through trial to come to a conclusive determination.

Under such circumstances, the instant revisional application is dismissed.

Copy of the order be sent to the Department and learned trial court for information.
