The case relates to dispute between brothers over transfer of shares in a private limited company. Several proceedings became pending. Pursuant to the settlement and compromise arrived at between the private parties, all the litigations including the present one are being settled and compromised. Copy of order no.12 dated 14.05.2025 as filed on behalf of the petitioners is taken on record. It appears that the plaintiff in T.S. No. 2437 of 2023

before learned Judge, Bench-III, City Civil Court, was permitted to withdraw the title suit and the same was dismissed as withdrawn.

Learned counsels appearing on behalf of the opposite party no.2/de fact complainant and opposite party no.3/victim submit that the disputes that had led to the registration of the instant FIR have already been finally settled between the private parties. There is no other victim or aggrieved person in this matter. Learned counsel appearing on behalf of the State relies on a statement of the de facto complainant recorded by the Investigating Officer, which is taken on record. It appears that the de facto complainant does not want to proceed further in this case as the matter has been amicably settled between the brothers.

In view of the settlement arrived at between the private parties, the proceeding in CGR Case No. 2540 of 2024 arising out of the New Alipore Police Station Case No. 116 of 2024 dated 20th September 2024 is quashed. Accordingly, the revisional application and the connected applications are disposed of.
