The revisional application was preferred challenging the proceedings arising out of Case No.C-23726 of 2011 pending before the learned Metropolitan Magistrate, 8th Court, Calcutta. The main thrust of contentions amongst others were regarding the involvement of the petitioners at the relevant point of alleged commission of offence. To that effect, the photostat copies of the transaction has been annexed.

Having regard to the fact that this Court cannot act on photostat copies of the transaction, at least, the original should have been brought before the court, I am of the view that the petitioners would be at liberty to adduce the same by way of evidence before the jurisdictional court. No interference on the merits of the case is warranted.

Accordingly, CRR 1647 of 2012 is dismissed.

Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.
