Learned senior counsel representing the petitioners submits as follows. The petitioners are the parents in law of the alleged victim. The marriage between the couple took place on 03.08.2025. The husband of the alleged victim is still in custody. Learned counsel appearing on behalf of the State relies on the case diary and strongly opposes the prayer for anticipatory bail. He refers to the postmortem report and the statements of witnesses including the statement of local independent witnesses. As per the statement of one Miraj Ahamed Mondal present at page 76 of the case diary, the husband of the petitioner was a drug addict. Because of that, he developed nerve ailments and used to have medicine. On the fateful day, he came to the pharmacist and said that his wife had
committed suicide. Then the witness, the petitioners and the other family members at the victim's matrimonial house arranged for taking the alleged victim to the hospital. Charge sheet has been submitted. Considering the above, the other materials available in the case diary, the fact that one of the principal accused being the husband of the victim is already in custody and the fact that charge sheet has been submitted, I am inclined to grant anticipatory bail to the present petitioners.
Accordingly, in the event of arrest, the petitioners shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of Arresting Officer and subject to the conditions as laid down under Section 438 of the Code of Criminal Procedure, corresponding to Section 482 of the Bharatiya Nagarik Suraksha Sanhita and on further condition that the petitioners shall not threaten or intimidate witnesses or tamper with evidence and shall surrender before the learned jurisdictional Court and pray for bail within four weeks from this date and shall regularly attend the jurisdictional Court. The application for anticipatory bail is, thus, disposed of. Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
