Versus

Smt. Soma Das The petitioner was aggrieved by the order of maintenance passed in an application under Section 125 of the Code of Criminal Procedure wherein the learned court on an appreciation of evidence was pleased to award Rs.5,000/- per month to the wife and Rs.3,000/- per month to the child aggregating to a sum of Rs.8,000/- per month.

I have perused the reasons so assigned by the learned Magistrate and I find that the same is based on factual matrix of the case. Consequently, no interference is required. Thus, CRR 1657 of 2012 is dismissed.

Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.

The wife/opposite party will be at liberty to recover the arrears by preferring an appropriate application before the jurisdictional court.
