It is submitted on behalf of the petitioner that he is in custody for about 1030 days. It is further submitted that co-accuseds have been enlarged on bail.
Learned advocate appearing for the State opposes the prayer for bail.
We have considered the materials on record. Petitioner was apprehended at the spot where the offence was committed. He does not stand on the same footing with co-accuseds who have been enlarged on bail. Prayer for bail of the petitioner was rejected earlier. Under such circumstances, we are of the opinion this is not a fit case to grant bail to the petitioner at this stage.
The application for bail is thus rejected.
