Learned counsel appearing for the alleged contemnor hands over a copy of a judgment and order dated July 28, 2025 passed in FMA 569 of 2024 which was preferred by the respondent in the writ petition against the parent order, in respect of which contempt has been alleged. The Division Bench, while disposing of the appeal, modified the impugned order and observed that the present petitioner, who was the respondent no. 1 before the appellate court, is free to participate in the tender process of the appellant. 2.

Learned counsel for the alleged contemnor submits that after the order under contempt was passed, there were two tenders floated by the

respondents in the writ petition. However, the present petitioner did not participate in either of the two. As such, there was no scope of the alleged contemnor preventing the petitioner from participating in the tenders floated by the respondent in the writ petition. 3.

Upon hearing learned counsel for the parties, this court is convinced that there is substance in the contention of the alleged contemnor to the effect that it would be premature to assume that the alleged contemnor would prevent the petitioner from participating in its tenders.

Accordingly, this court is of the opinion that no case of contempt has been made out.

Hence, CPAN 781 of 2024 is dismissed without any order as to costs.
