For the State ,, The grievance of the petitioner is directed against illegal encroachment by the private respondent. The State in their affidavit-in-opposition at page 6 sub-paragraph (d) of paragraph 5 have unequivocally and categorically averred that there is illegal and unlawful encroachment by the private respondent No.10. The private respondent is not represented.
However, in view of the admitted, indisputable and unassailable position stand taken by the State respondent in its affidavit-in-opposition in respect of the illegal encroachment, liberty is granted to State to take appropriate steps in accordance with law under the State Highways Act, if so advised for removal of the illegal encroachment.
With the aforesaid direction, W.P.A. 10047 of 2019 stands disposed of.
