Lohari Roy Mr. Surya Prasad Chattopadhyay Mr. Arjun Samanta ... for the Petitioner This is an application wherein the petitioner has prayed for expeditious disposal of the petitioner's application filed before the court below under Section 340 of the Code of Criminal Procedure against the opposite party herein being case no. 438-C of 2023, presently pending before the learned Chief Judicial Magistrate, Bankura. It is submitted on behalf of the petitioner that the said application was filed on 23rd November, 2023 and in spite of expiry of a considerable period of time, it has not yet been disposed of. Having heard learned counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if any order passed in terms of the prayer made in the application, the opposite party will have no cause to prejudice, the service of copy of the application upon the opposite party is dispensed with.

Since the prayer made by the petitioner appears to be justified in terms of the long pendency of the case, the instant application being CRR 2202 of 2025 is hereby disposed of with a direction upon the court below to dispose of the said application as expeditiously as possible in accordance with law preferably within a period of six months from the date of communication of the order.
