Learned advocate appearing for the petitioner submits that there has been alleged recovery of 50 kg of ganja but the mode and manner of recovery do raise a doubt regarding the complicity of the present petitioner and the petitioner is in custody for about a year. Learned advocate appearing for the State opposes the prayer for bail and emphasizes that that the petitioner is thickly involved in the alleged offence.

Having considered the quantum of contraband/ganja recovered in the present case, I am of the view that the rigors of Section 37 of NDPS Act is attracted.

At this stage, the prayer for bail of the petitioner in CRM (NDPS) 1083 of 2026 is rejected.

Petitioner shall renew his prayer for bail after the evidence of seizure list witnesses are over.

The learned trial Court would give priority to the evidence of the seizure list witnesses preferably within a period of three months from date of communication of this order.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
