Affidavit-of-service filed on behalf of the petitioner is taken on record.

Petitioner made an application for transfer on general ground (distance) lastly on 2nd November, 2021 and same was sent back to the petitioner on 2nd December, 2021 as it appears from a document at page 46 of the writ petition. The reason assigned by the school authority in support of sending back transfer application to the petitioner is that it was found petitioner was a single teacher in the subject. It is contended on behalf of the petitioner in the event petitioner is found to be a single teacher in the school his transfer application is required to be forwarded to the concerned District Inspector of Schools (SE), North 24 Parganas being respondent

no.5 for taking necessary steps in terms of Government notification dated 3rd January, 2022 for providing local arrangement in the school of the petitioner to facilitate his transfer.

State respondents and West Bengal Central School Service Commission are represented by learned advocates who have submitted since petitioner was found to be a single teacher his transfer application is required to be forwarded to respondent no.5 for taking necessary steps.

In spite of service of notice authority of Ranghat Anchal High School (HS), North 24 Parganas being respondent nos.7 & 8 are not represented by learned advocates.

The Headmaster of the aforesaid school being respondent no.8 is directed to forward the transfer application of the petitioner dated 2nd November, 2021 in offline mode to the respondent no.5 by fortnight from the date of communication of his order.

On receipt of transfer application, respondent no.5 shall take steps strictly in terms of Government notification dated 3rd January, 2022 thereby making an endeavour to find out willing teacher to man the post of the petitioner after transfer of the petitioner till regular incumbent joins the post.

In the event willing teacher is available petitioner shall be transferred immediately thereafter on following the procedure as contained in Government notification dated 3rd January, 2022.

The writ petition stands disposed of.

There shall be, however, no order as to costs. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
