1. Affidavit of service filed on behalf of the petitioner is taken on record.

2. It is submitted on behalf of petitioner that under a Scheme of West Bengal Government fund is sanctioned in favour of petitioner for constructing residential house on his land. It is alleged that private respondent is obstructing petitioner in constructing his house thereby prompting the petitioner to approach this Court with the present writ petition seeking necessary direction upon the concerned police authorities.

3. Prayer is made in this writ petition for giving direction upon the concerned police authority which would facilitate the petitioner to raise construction.

4. State respondents are represented by Mr.

Suryaneel Das, learned Additional Government Pleader who opposes this writ petition based on the statements made in the complaint of the petitioner dated 11th May, 2026 addressed to the concerned police authority.

5. On perusal of complaint dated 11th May, 2026 it is found that property in question is un partitioned and Court is apprised of pendency of partition suit before the Civil Court. It is stated in the complaint that there is an oral arrangement made with regard to possession of property in question.

6. Police authority is not the appropriate authority to demarcate the land of the petitioner and private respondent. Petitioner is required to approach the Civil Court in pursuit of remedy.

7. Concerned police authorities are directed to maintain peace and tranquility at the locale.

8. Writ petition stands disposed of.

9. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
