(DB) 1783 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Joynagar Police Station Case No. 1203 of 2018 dated 24.01.2020 under Sections 341/302/120B/34 of the Indian Penal Code and under Sections 25/27 of the Arms Act and Sections 3/4 of the Explosives Substances Act.

And In Re : Firoz Gazi alias Feroz Gazi ..... petitioner Mr. Angshuman Chakraborty Mr. S. S. Saha ... for the petitioner Mr. Madhu Sudan Sur, learned APP Mr. Manoranjan Mahata ... for the State Learned Counsel appearing for the petitioner prays for bail. He submits that the petitioner was earlier on bail but his bail was cancelled by a coordinate Bench of this Court in CRM 6697 of 2020. Since then, he is in custody for 162 days. Coaccuseds are on bail. Learned Counsel appearing for the State opposes the prayer for bail and submits that three persons died. Bullet recovered from the body of one of the victims matches with the firearm recovered from the petitioner.

We have considered the materials on record. There are prima facie materials connecting the petitioner in the gruesome murder of three persons.

In view of gravity of the offence and prima facie involvement of the petitioner therein, we are of the opinion in view of gravity of the offence this is not a fit case to grant bail to the petitioner at this stage.
