It is submitted by the petitioner that their objection insofar as installation of a new substation at the Basirhat Area has not been considered.

On behalf of the WBSEDCL, it is submitted that the entire grievance of the petitioner is misconceived and ill-founded. The proposal for installation of a sub-station is not justiciable. Significantly, the proposed sub-station is indispensable for the following reasons:

a) Mitigation of persistent low-voltage problems;

b) Reduction of restoration time against breakdowns and emergencies;

c) Improvement of reliability and quality of electricity supply;

d) Meeting present and future electricity demand;

e) Ensuring uninterrupted power supply to public institutions and strategic Border Out Posts situated along the IndoBangladesh border for national safety and security.

In any event, electricity being a essential public utility it is in public interest that the substation be installed. In view of the submissions made on behalf of the parties, the petitioner has been unable to demonstrate any enforceable legal right justifying interference by this Court.

The grievance of the petitioner is illfounded and without any basis. There is no scope of Writ Court to adjudicate upon the policy decision of the WBSEDCL in installing a substation at the subject area. In such circumstances, there is no merit in the present writ petition.

WPA 11620 pf 2026 stands dismissed.
