The grievance of the petitioner is directed against inaction of the WBSEDCL in providing an electricity connection to the premises of the petitioner.

On behalf of the private respondent it is submitted that electricity cannot be provided since the premises is situated on agricultural land and it is not possible to provide such connection through such land. On behalf of the WBSEDCL a Report has been filed wherein the WBSEDCL has sought for installation of six number of PCC poles on a thin stretch of land/pathway leading to the premises of the petitioner.

In view of the nature of the disputes raised by the parties, WPA 11617 of 2026 stands disposed of by referring the matter to the concerned District

Magistrate (being the respondent no.3 herein) having jurisdiction to decide on whether it is possible to provide such connection.

It is made clear that there is no adjudication on the merits of the case and all questions are left open for the respondent no.3 to decide in accordance with law after giving all the parties including WBSEDCL and the private respondent a right of hearing. The above exercise is to be completed within a period of eight weeks from the date of communication of this order.
