The learned Advocate appearing for the petitioner draws the attention of this Court to the contents of the First Information Report. He submits that the petitioner is in custody for about one year.

The learned Additional Public Prosecutor appearing for the State draws attention of this Court the materials in the case diary and the statements of the witnesses recorded under Section 164 of the Code of Criminal Procedure. Considering the materials in the case diary, the gravity of the offence and the complicity of the petitioner as appearing from the statements recorded under Section 164 of the Code of Criminal Procedure, we are unable to grant bail to the petitioner.
