It is submitted on behalf of the petitioner that 44.400 Ganja was allegedly recovered from joint possession of seven accused persons including present petitioner who is a lady accused. She is in custody for about for two years. He further submits as per chargesheet the prosecution is required to examine twelve witnesses and so far they could examine only three witnesses. As such nobody knows when the trial would be concluded and therefore she may be released on bail on any terms and conditions.
Mr. Dutta, learned counsel appearing on behalf of the State submits that the bail prayer of present petitioner was lastly rejected by this court on 08.07.2024 and that commercial quantity of contraband substance was recovered from the joint possession of the petitioner.
He further submits that the trial is expected to be concluded within short period and as such he opposed the prayer for bail.
Having heard the learned counsel appearing on behalf of the petitioner and the State it appears that though the petitioner has already suffered incarceration for about two years but still there appears to be hardly any chance of early conclusion of trial.
In view of above, the prayer for bail made by the petitioner is allowed only on the touchstone of Article 21 of the Constitution of India.
Accordingly, the petitioner namely, Sangita Shaw shall be released on interim bail upon furnishing a bond of Rs. 20,000/- with two registered sureties of Rs. 10000/- each, of which one must be local, subject to the satisfaction of the learned Chief Judicial Magistrate, Barasat, North 24-parganas and also on condition that the accused person shall not misuse the liberty granted by this Court and he shall not tamper with any evidence orally or documentary during the trial. He shall not absent himself on any day during trial and shall not commit any offence while on bail. He shall give his mobile phone number to the local police station and shall not change it without prior permission of the trial court and he shall not in any manner try to delay the trial. The petitioner shall not leave the geographical limit of District of North 24-pargnas without taking leave from the court below and shall meet the
Investigating Officer, Lake Town Police Station thrice in a week until further order.
Accordingly, C.R.M. (NDPS) 589 of 2025 is disposed of. Urgent Photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all requisite formalities.
