Heard the learned Counsels appearing on behalf of the parties.
Report is placed on record which shows monetary transactions between one Meher Ali, Asikul Islam and Masidur Rahaman. The said Asikul Islam and Masidur Rahaman carries on business of online financial transactions. Their statements prima facie show petitioner had approached them to make the aforesaid monetary transfers to Meher Ali. In view of the aforesaid materials on record showing monetary transactions between petitioner and co-accused Meher Ali through the aforesaid conduits, we are of the opinion there is sufficient material connecting him with the alleged crime of dealing in narcotic substance above commercial quantity.
Under such circumstances and in the light of the statutory restrictions under Section 37 of the N. D. P. S. Act this is not a fit case to grant bail to the petitioner.
Accordingly, the prayer for bail of the petitioner is rejected.
