Learned advocate appearing for the petitioner submits that although 1 year and 8 months have passed, there has been no progress in the case. Charge sheet has been submitted and the petitioner has been implicated on the accusations of alleged recovery of 102.9 Kgs. of Ganja.

Learned advocate for the State opposes the prayer for bail on the ground of huge recovery.

Having considered the quantity of contraband, I am not inclined to release the petitioner on bail. However, the Court cannot keep an accused for an indefinite period of time. As such, learned Special Court is directed to split up the trial of

the case and proceed with the witness action after framing of charge.

Accordingly, CRM (NDPS) 1098 of 2026 is dismissed. Registrar General, High Court, Calcutta will communicate this order to the learned Additional District and Sessions Judge, 2nd Court cum Judge Special Court, under NDPS Act at Berhampore, Murshidabad.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
