It is submitted by counsel for the petitioner that the private respondents are obstructing construction work of the petitioner. A complaint in this regard has been lodged by the petitioner as well as the National Highways Authority on 16th June, 2021.

The Officer-in-Charge, Nakashipara Police Station submits that proceedings under Sections 107/116 of the Code of Criminal Procedure have been drawn up against the private respondents. The said private respondents have assured the police that they would not interfere any further with the writ petitioner's possession and have also executed a bond to that effect with the said police station.

In the view of the matter, the Officer-in-Charge, Nakashipara Police Station shall ensure that there is no breach of peace in the said area and that the

private respondents do not interfere with the writ petitioner's construction in any manner whatsoever. With the aforesaid observations, the writ petition is disposed of.

The instructions of the Inspector-in-Charge, Nakashipara Police Station dated 31.07.2021 is taken on record.

There will be no order as to costs.
