Ghosh ..for the State Mr. Suman Bose ..Principal A.G.(A&E) Having considered the report filed by the Project Director, District Rural Development Cell, Nadia Zilla Parishad, the respondent no.4 herein, this Court directs that the admissible dues, namely, gratuity, leave salary and other retirement benefits of the petitioner as well as 2/3rd of the pension shall be paid as per Death Cum Retirements Benefit Scheme, 1985 within a period of two months from the date of communication of this order. 2/3rd pension shall be paid month by month every month till disposal of the criminal case, in case the same is pending. Upon disposal of the criminal case, the pension shall be paid in accordance with law and subject to the decision of the Court and the DCRB scheme.

The writ petition is, thus, disposed of. There shall be no order as to costs.
