Ms. Barnali Gupta Mr. Sk. Nazimuddin ... for the Petitioner This is an application wherein the petitioner has prayed for expeditious disposal of G.R. case no. 2666 of 2024 under Section 420/406/34 of the IPC, presently pending before the learned Additional Chief Judicial Magistrate, Kalna.

Since the prayer made by the petitioner is innocuous and if any order passed in terms of the prayer made in the application, the opposite party will have no cause to prejudice, the service of copy of the application upon the opposite party is dispensed with. Having heard learned counsel for the petitioner, it appears that the charge-sheet in the instant proceeding was filed on 31st December, 2022 and since then, the matter is pending for charge hearing. In such circumstances, the prayer made by the petitioner appears to be justified and as such, it is allowed.

CRR 2203 of 2025 is accordingly disposed of with a direction upon the court below to make every endeavour for making charge hearing of the case without making any further delay preferably within a period of two months from the date of communication of the order. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of the all requisite formalities. (Dr. Ajoy Kumar Mukherjee, J.)
