In this case the petitioner's approval in the post of headmaster was made on 19.03.1988. At that point of time he was given approval as B.A. and B.Ed. qualification holder. Subsequently, the petitioner submits, he obtained M.A. qualification in History from Burdwan University and the school in 2003 made one prayer to the concerned District Inspector of Schools for granting him higher scale of pay.

The petitioner has retired in 2010. The petitioner has made huge delay in filing this writ application which has been at least after 16 years from 2003 and this court is also not satisfied about his entitlement to get the higher scale of pay.

However, learned advocate for the petitioner wants to withdraw the writ application.

Therefore, the writ application is dismissed without, however, granting any opportunity to file a fresh writ application on the self-same cause of action. (Abhijit Gangopadhyay, J.)
