The petitioners are aggrieved by the fact that two of the witnesses could not be examined namely P.W.1 and P.W.3 as the petitioners could not make themselves available before the court and the evidence was closed. Having considered that the petitioners are facing sessions triable offence, I direct that the learned Additional Sessions Judge, Fast Track Court, Kalyani, Nadia to recall the said two witnesses namely Lakshmi @ Laxmi Mondal and Santosh Mondal on two consecutive dates for cross-examination of the said witnesses on behalf of the present petitioners namely Biplab Mondal and Durlab @ Durlav Mondal . The recall of the witness would be subject to the deposit of Rs.5000/- to the District Legal Aid Services Authority, Nadia. The learned trial court would check the receipt and thereafter allow the recall of the witnesses. Date be fixed in the first week of July, 2024 for the cross-examination of the two witnesses named above. With the aforesaid observations, the present revisional application being CRR 1799 of 2024 is disposed of.
