1) Petitioner prays for mandamus by giving direction upon the concerned respondents to transfer her from her present school in Purba Bardhaman to another school in Paschim Bardhaman since petitioner is permanent resident of Paschim Bardhaman. It is submitted that transfer application dated 27th March, 2025 has been made on medical ground since petitioner is suffering from ailments.

2) Respondents are represented by learned advocates.

3) On perusal of application for transfer dated 27th March, 2025, it appears that primarily

transfer application is made due to ailment of petitioner's father. Transfer application is silent as to nature of ailment petitioner is suffering from. In terms of relevant transfer rules illness of father is not a ground to transfer an applicantteacher. Transfer application on medical ground can only be made if applicant-teacher or his/her spouse or children are suffering from specified disease.

4) Considering the transfer application dated 27th March, 2025 no relief can be granted to the petitioner.

5) Hence, writ petition stands dismissed.

6) However, this order shall not preclude the petitioner to make transfer application in future in accordance with law.

7) Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertakings.
