16.06.2022 sdas rejected C.R.M. (NDPS) 636 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Cossipore Police Station Case No. 172 dated 01.10.2020 under Section 21(C )/29/27(A) of the NDPS Act.

And In Re : Rabiul Mondal @ Rabi Kana @ Kana Rabi ..... petitioner Mr. Satadru Lahiri Ms. Poulomi Chakraborty ... for the petitioner Mr. Sanjoy Bardhan Ms. Baishakhi Chatterjee ... for the State Petitioner renews his prayer for bail. It is contended that he is in custody for one year and three months. Learned Counsel appearing for the State opposes prayer for bail. He submits that the petitioner had financed illegal transactions in narcotic substance.

We have considered statements of the witnesses including bank statements which show monetary transactions between the petitioner and co-accuseds dealing in narcotic substance.

In view of the aforesaid facts and as his prayer for bail was rejected earlier, we are not inclined to grant bail to the petitioner.

The application for bail is, thus, rejected.

However, we request the trial court to take necessary steps to consider the issue of framing of charge at the earliest and in the event such charge is framed to conclude the trial as expeditiously as possible without granting any unnecessary adjournment to either of the parties.
