Learned counsel for the parties do not dispute that in the meanwhile respondent has filed the affidavit-inopposition and the matter is ripe for hearing and in fact it is already included in the hearing list. A joint submission has been made by learned counsel for the parties that the interest of justice will be served, if the main matter itself is heard expeditiously.

Hence, we dispose of this appeal granting liberty to the parties to make a request to the concerned learned single Judge for taking up the petition for hearing on an early date.

MAT 700 of 2021 We express hope that having regard to the nature of controversy involved in the matter, the prayer made by learned counsel for the parties will be duly considered. Accordingly, the appeal along with connected application is disposed of.
