For the petitioner Mr. Partha Pratim Ray Mr. Subhabrata Das ...For the State The petitioner submits that she was the teacher of the school and after her retirement on 31.10.2015 she was not given the retiral benefit and for which she filed one writ petition against which she was granted retiral benefit on 04.02.2020. The petitioner also refers to one order of the Commissioner of School Education to the Director of Pension, Provident Fund and Group Insurance, West Bengal dated 13th January, 2020 wherein it was specifically mentioned that the retirement benefits of the petitioner along with the interest which is due to the petitioner was to be paid. The petitioner's allegation is that the retiral benefit has been paid to her but no interest has been paid to her for the entire amount despite the order passed by the Commissioner of School Education which was addressed to the Director of Pension, Provident Fund and Group Insurance, West Bengal.

The petitioner has shown necessary pleadings in this regard in the writ petition.

Learned advocate for the respondents/State submit that the petitioner disputed certain amounts but such dispute cannot create impediment in payment of interest to the petitioner in respect of the amount already paid to him.

In the facts and circumstances, I direct the respondent No.4 to pay the interest on the entire amount which has been paid for the delayed period to the petitioner within a period of eight weeks from the date of communication of this order.

With the above direction, this matter is disposed of.
