Bhowmick ... for the respondent no.13 Re The petitioner is aggrieved by the fact that the police authorities have not taken any steps on the basis of the information which was furnished to them.

It has been alleged that the private respondent no.13 has been digging soil in respect of the land which was a brickfield where the petitioner was earlier carrying on business of brickfield.

According to the petitioner, the act of the private respondent no.13 is bound to change the nature and character of the

property.

The petitioner also accuses that some of the local police authorities have been hand in glove with the private respondent no.13.

State has submitted a report which reflects that five cases inter se between the petitioner and the private respondents were registered for investigation being Kaliachak PS Case No.

246 of 2022, Kaliachak PS Case No. 588 of 2022, Kaliachak PS Case No. 603 of 2022, Kaliachak PS Case No. 266 of 2024 and Kaliachak PS Case No. 267 of 2024.

Report further depicts that there has been subsequent settlement between the petitioner and the private respondents at the behest of the respected religious leaders of the locality.

It is also pointed out that the genesis of the dispute had its origin in

family conflict. Reports, to such effect, have been submitted before the learned jurisdictional court earlier. The petitioner also preferred a writ petition being WPA 7281 of 2024.

Having regard to the facts which have been submitted by the police authorities and the averments made in the writ petition, I am of the view that the detail as provided in the report are absent in the present writ petition.

Consequently, I am of the opinion that there has been suppression of facts which do not warrant interference of this Court, as such, WPA 11223 of 2025 is dismissed.

Pending application(s), if any, is also disposed of.

Report so submitted be kept with the record. Copy of the report be handed over to learned advocate for the petitioner.
