The Panchayat and the private respondent are not represented despite service.
Pursuant to an order passed by this Court on 8th May, 2023 in WPA 6768 of 2023, the Bally-Jagacha Panchayat Samiti, by an order passed on 8th July, 2025, held that the existing building (Anjana Bhawan) constructed by the private respondent was illegal. The private respondent was directed to demolish the said structure within 30 days from the date of issuance of the order failing which, the Panchayat Samiti would take necessary legal action as per Panchayat Rules. Learned counsel for the petitioner submits that the said order has not been complied with by the private respondent and no consequential step has also been taken by the Panchayat Samiti.
The petitioner seeks implementation of the order.
In view of the fact that the order dated 8th July, 2025 has been passed by the Panchayat Samiti in compliance with the order passed by this Court, the Sabhapati, Bally-Jagacha Panchayat Samiti, being the 4th respondent herein, is
directed to implement the said order in terms of the relevant Panchayat Rules within four weeks from the date of communication of this order.
The 4th respondent is at liberty to seek police assistance for implementation of the order.
The Officer in Charge of the Liluah Police Station, being the 5th respondent herein, is directed to render all possible assistance to the 4th respondent in this regard. The writ petition is disposed of.
There shall be no order as to costs.
Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.
Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
