The records of the case reflect that pursuant to the order dated 04.07.2024, the police authorities had undergone further investigation of the case.
Consequently, Jagacha PS Case No. 248 of 2022 was reopened and investigation resumed.
However, today, a report has been submitted on behalf of the State which reflects that as a counter-blast to the
case being Domjur PS Case 1089 of 2017, the present case was instituted.
The police authorities on different dates issued notice to the injured, namely, Satabdi Chakraborty for supply of the reports. However, the documents relating to Habra State General Hospital inspite of efforts could not be collected till date by the investigating officer.
The incident complained of is of the year 2016, as such, the investigating officer found it difficult to retrieve the medical documents.
Having considered that efforts are being taken by the investigating officer, I am of the opinion that since the incidents complained of are of the year 2016; FIR is of the year 2022; initially, Report in Final Form was submitted in the year 2023 and the further investigation is being carried on pursuant to the directions dated 04.07.2024, the police authorities will
exhaust their efforts and try to submit their report under Section 173 of the Cr.P.C. preferably within a period of three months from the date of communication of this order.
With the aforesaid observations, WPA 11242 of 2025 is disposed of.
Pending application(s), if any, is also disposed of.
Report so submitted be kept with the record. Copy of the report be handed over to the petitioner.
