For the State The petitioner renews his prayer for bail primarily on the ground that co-accused Rehena Bibi has been granted bail by the learned Session Judge (In-Charge) Murshidabad. The petitioner is in custody for about 336 days. Learned counsel for the State opposes the prayer. I have considered material on record. The bail prayer of the petitioner was turned down by this Court as recently as on February 21, 2025 considering the material on record. Though the petitioner is not named as the principal assailant in the statement of witnesses under Section 164 of the Code of Criminal Procedure, there is incriminating material against him prima facie connecting him to the alleged offence. The offending weapon has also been recovered from his house pursuant to his leading statement.
Considering the material on record prima facie connecting the petitioner to the alleged offence, prayer for bail is rejected at this stage.
The bail application is disposed of.
