1. By way of filing this public interest litigation petition the petitioner alleges that the private respondents have been put up illegal construction and running hotel business therefrom.

Photographs, which have been annexed in the writ petition, show that construction has been completed and hotel is functioning in the said area. It is not clear as to why the petitioners did not take any action when construction was in progress. In any event, since the writ petition is disposed of without calling for affidavits, it is open to the petitioners to submit a representation before the appropriate authority, who is stated to the District Magistrate, South 24 Parganas, 5th respondent herein. The petitioner is directed to appear in person before the District Magistrate and submit a copy of the representation and other documents along with a copy of this order so as to enable the District Magistrate to take appropriate action in accordance with law as expeditiously as possible.

2. With the aforesaid direction, the writ petition is disposed of.
