1. Mr. Bhaskar Prasad Vaisya represents on behalf of the Director of Pension, Provident Fund & Group Insurance, West Bengal.

2. It is stated that from the order dated 24th August, 2022 is not clear as to exactly when the pension should be effective from since the petitioner died on 19th August, 2009 and would have normally superannuated on 31st August, 2009.

3. In the facts and circumstances of the present case, it is clarified that the arrears pension payable to the petitioner shall commence from the date of superannuation i.e. 1st September, 2009. The aforesaid date of superannuation of the petitioner is recorded on the basis of submission of Mr. Panda, learned Counsel, who submits on instructions.

4. In the event the date of retirement and superannuation is different from what has been submitted by the petitioner, liberty is reserved to the Director of Pension, Provident Fund & Group Insurance, West Bengal to take steps in accordance with law.

5. It is ordered that all arrears of pension shall be paid to the petitioner within ten days from date.

6. With the aforesaid directions, the instant contempt application shall stand disposed of.

7. Rule, if any, shall also stand discharged.

8. There will be no order as to costs.

9. All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
