Wasim Akram ....for the petitioner The petitioner has approached this Court by filing an application under Article 227 of the Constitution of India challenging the writ of possession dated March 7, 2025 issued under Section 5(2) of the Public Premises (Unauthorised Occupants) Act, 1971 read with Rule 7 of the 1971 Rules.

Petitioner preferred a miscellaneous appeal challenging the order passed by the Estate Officer on March 31, 2015. The said miscellaneous appeal, however, stood dismissed for default on February 17, 2025. The petitioner filed an application under Order 41 Rule 19 of the Code of Civil Procedure praying for restoration of the said miscellaneous appeal. The learned advocate for the petitioner submits that the next date has been fixed for hearing of such application under Order 41 Rule 19 of the Code of Civil Procedure on June 2, 2025. The learned advocate further submits that an interim protection be granted to the petitioner till June 2, 2025.

CO 1775 of 2025 is disposed of by giving liberty to the petitioner to approach the learned Judge, 3rd Bench, City Civil Court at Calcutta for appropriate reliefs. If such an application is filed the learned Judge is requested to consider the same and pass orders in accordance with law.

There will be no order as to costs.
