The petitioners are aggrieved with the stop work notice issued by the Chairman, Panskura Municipality dated 13th January, 2021. According to the petitioners, the petitioners have already obtained a sanctioned building plan for construction of G+2 floor residential building. Accordingly, the petitioners have commenced construction. Unfortunately, the municipality has issued the notice dated 13th January, 2021 as thereafter not taken any steps.

Despite service the municipality is not represented though, the private respondent and the State are represented in Court today.

Having heard learned advocates appearing for the respective parties, I am of the view that the stop work notice issued by the municipality dated 13th January, 2021 must be brought to a logical conclusion unless the same has already been dealt with.

Accordingly, the municipality is directed to hear out the parties and decide on the stop work notice by passing a reasoned order in accordance with law on an expeditious basis, preferably within a period of four weeks from the date of communication of this order. The reasoned order must be communicated to the parties.

With the above observation, the writ petition stands disposed of.

It is made clear that this Court has not gone into the merits of the cause or any title dispute. 7.

It is also made clear that the municipality shall not enter into any title dispute between the parties. 8.

All parties are act on the basis of a copy of this order duly downloaded from the official website of this Court.
