And In Re : Debajyoti Biswas ...... petitioner Mr. Navanil De Mr. Subhrajit De ....for the petitioner Mr. Rudradipta Nandy Ms. Eshita Dutta ....for the State Petitioner prays for anticipatory bail.

Learned advocate appearing for the petitioner submits that, the petitioner was falsely implicated. The petitioner is not involved in the so-called financial irregularity. Learned advocate appearing for the State submits that, as a Manager of the Punjab National Bank of a branch, the petitioner faced disciplinary proceeding in respect of similar nature of transactions. In the present case, the de-facto complainant applied for loan of Rs.5 lakhs. The petitioner directed the de-facto complainant to prepare documents with regard to the loan from one particular person. Subsequently,

the de-facto complainant found its account to be credited a sum in excess of Rs. 16 lakhs and immediately thereafter a sum in excess of Rs.15.80 lakhs being transferred to different parties. It is contended on behalf of the petitioner that the petitioner did not receive the proceeds of such sum. Considering the materials in the case diary, the gravity of the offence and the involvement of the petitioner as appearing therefrom, we are unable to grant anticipatory bail to the petitioner.

Accordingly, prayer for anticipatory bail of the petitioner is rejected and the application being CRM (A) 2794 of 2022 is dismissed.
