Nemai Das & ORS v. State Of West Bengal
C.R.R.1619 of 2008 D/L50 August 3, Bpg.
In Re: An application under Section 401 read with 482 of the Code of Criminal Procedure, 1973;
Sri Nemai Das and others
Versus
The State of West Bengal and another Mr. Sandip Chakraborty.
...for the State.
The present revisional application has been preferred challenging the proceedings being Faridpur Police Station Case No.04/08 under Sections 498A/323/307 of the Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act and corresponding to G.R. Case No.72 of 2008.
As none appears on behalf of the State, Mr. Sandip Chakraborty, learned advocate, who ordinarily appears on behalf of the State, is directed to represent the State. His appointment may be regularised by the concerned authorities.
Records reflect that the interim order was operative till 21st January, 2021. The said interim order was never extended. More than 13 years have passed since then and no information has been furnished before this Court regarding the present stage of the proceedings.
Having regard to the fact that the petitioners approached this Court at the very initial stage of the case, I am of the opinion that no interference is called for as the issues raised relate to mixed questions of fact and law.
Accordingly, CRR 1619 of 2008 is dismissed.
Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
