And In the matter of: Kalu Sk @ Kalam Sk & another. Petitioners Mr. Md. Golam Nure Imrohi Mr. Partha Pratim Sinha ...for the petitioners Mr. Brajesh Jha, Ld. APP Mr. Mukesh Kr. Gupta ...for the State Memo of evidence filed on behalf of the State is taken on record. Learned counsel appearing on behalf of the petitioners submits that the petitioners have been falsely implicated in this case. There are case and counter case and both side sustained injuries.

Learned Additional Public Prosecutor relies on the case diary and opposes the prayer for anticipatory bail. He refers to the injury report which shows that the injury resulted in rupture of globe of left eye of one of the victims. The assault was made with iron rod. He also refers to the statements of the victims and the independent eye-witnesses. Considering the above and the other incriminating materials available in the case diary, I do not consider this is to be a fit case for granting anticipatory bail.

Accordingly, the application for anticipatory bail is rejected. Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible. (Jay Sengupta, J.)
