12.05.2023 Ct. No. 29 KAUSHIK REJECTED C.R.M.(A) 1959 of 2023 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Palashipara Police Station Case No. 228 of 2022 dated 28.06.2022 under Sections 341/326/307/34 of the Indian Penal Code.

And In Re : Saddam Shaikh ...... petitioner Mr. Asraf Mondal ....for the petitioner Ms. Purnima Ghosh ....for the State In an incident of assault, the injured suffered an injury with a sharp object on the neck. There is a cut injury of about 8 to 10 centimeters on the right side of the neck. The petitioner stands implicated in the incident of assault.

Considering the nature of injury suffered by the petitioner and the involvement of the petitioner in the incident and the materials in the case diary, we are unable to grant anticipatory bail to the petitioner.

Accordingly, prayer for anticipatory bail of the petitioner is rejected and the application being CRM (A) 1959 of 2023 is dismissed.
