Learned advocate appearing for the petitioner submits that the petitioner is a lady, she is innocent of the charges and has been falsely implicated in connection with the present case for alleged recovery of 53 kgs. of Ganja from a vehicle. Petitioner was only a rider in the vehicle and she has been implicated in the present case. There has been no criminal antecedent of the present petitioner. It has further been contended that prosecution has relied upon 17 witnesses in order to prove its case. As such, there is no scope of the trial being concluded in the near future. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that recovery in the present case is of commercial quantity and the prosecution has been able to establish a link between the present petitioner and the contraband which was recovered.

Having considered the quantum of recovery in the present case, at this stage, I am not inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is rejected.

Petitioner will renew her prayer for bail after the evidence of seizure list witnesses is completed. Learned Trial Court would give priority to the examination of the seizure list witnesses preferably within a period of three months from the date of communication of this order.

Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. The application for bail, being CRM (NDPS) 1092 of 2026, is, thus, disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
