Mr. Ayan Poddar........for the petitioners Learned advocate appearing on behalf of the petitioners submit that the instant case has become infructuous due to filing of chargesheet against the other accused persons leaving these two petitioners herein. Both petitioners are discharged from the case and also discharge from their bail bonds. A photocopy of the said order filed by the petitioners is taken on record.

It appears from the submission and order filed today, learned Additional Chief Metropolitan Magistrate, Calcutta passed an order dated 24.09.2019 discharging both the petitioners herein namely, Siyaram Yadav, Deputy Manager Finance of Mangalore Refinery and Petrochemical Ltd and Yathiraj Salian, Retired Senior Manager (Admn.), Mangalore Refinery & Petrochemical Ltd., respectively and also discharge from their bail bonds from the proceeding of G.R. Case No. 1387/2016 arising out of Burrabazar P.S. Case No. 279 dated 23.06.2016 registered under section 420, 464, 468, 469, 471, 120B IPC pending before the learned Additional Chief Metropolitan Magistrate, Calcutta. In view of the facts and circumstances, the instant revisional application has become infructuous.

Accordingly, the instant revisional application being CRR 1428 of 2017 is dismissed being infructuous without any order as to costs.

Interim order, if any, stands vacated.

Department is directed to send down the lower court records, if any, immediately.

Let the order be communicated to the Ld. Court below for information.

Liberty is granted to all parties to act in terms of the copy of this order downloaded from the official website of this court.
