The petitioner is aggrieved by the fact that the Complaint Case No. AC-699 of 2020 is pending before the learned Judicial Magistrate, 6th Court, Alipore for more than three years, but till date the evidence has not commenced. Learned advocate appearing for the petitioner submits that the examination under Section 251 of the Code of Criminal Procedure is over and the learned Magistrate has been pleased to award interim compensation in terms of Section 143A of the Negotiable Instruments Act. The next date has been fixed on 01.03.2024. Having regard to the fact that examination/evidence of PW-1 is yet to commence, I direct the learned trial court to fix at least one date in every two months for the purposes of the present case so that trial of the case can be taken to its logical conclusion within a reasonable period of time.
No unnecessary adjournment be granted to any of the parties. In case any dilatory tactics are adopted by the parties, the learned Magistrate would be at liberty to impose exemplary cost, if the learned Magistrate finds that on flimsy grounds adjournment is sought for.
All efforts be taken so that trial of the case can be concluded at the earliest.
With the aforesaid observations, the revisional application being CRR 1730 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.
All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
