Mr. Susovan Sengupta Mr. Subir Pal ... for the State The Sub-Divisional Controller and Ex-Officio Assistant Director, Food & Supplies, Tamluk, Purba Medinipur passed an order dated 25th June, 2021 wherein it has been mentioned that as per direction and order of the Director, DDP&S, the highest appellate authority and order of Deputy Director (License) vide Memo No. 1384-FMR/12A16/14 dated 23rd June, 2021 the license of the petitioner of FPS license has been restored.

The learned advocate for the petitioner submits that the copy of the reasoned order of the appellant authority dated 24th March, 2021 in connection with appeal filed by the petitioner on 1st March, 2021 has not been received by her till date.

By a further communication dated 7th July, 2021 the Sub-Divisional Controller and Ex-Officio Assistant Director

wrote to the Area Inspector, Food & Supply to issue allotment of M.R. commodities to the petitioner. The writ petition was filed for implementation of the said order and for a direction for issuance of allotment in favour of the petitioner. Today when the matter is taken up for consideration by the Court, it has been submitted by both the parties that allotment has since been restored. In view of such submission the writ petition is disposed of by directing the concerned authority to transmit the reasoned order dated 24th March, 2021 passed by the appellate authority to the petitioner, at the earliest, but positively within a fortnight from the date of communication of a copy of this order.

The writ petition stands disposed of.

Urgent photostat certified copy of this order, if applied for, be given to the parties on completion of usual formalities.
