The applicant before the Central Administrative Tribunal, Kolkata Bench (hereinafter referred to as the 'C.A.T.) is the petitioner in the present proceedings. He is aggrieved by non-grant of an interim order in respect of his transfer from the post of Regional Provident Fund Commissioner-II at R.O., Kolkata to the station at R.O., Mumbai, Bandra.

The learned counsel for the petitioner submits that the petitioner has already joined the transferred place of posting reserving his right to question the legitimacy and validity of the transfer. Since such challenge is pending before the C.A.T. in O.A. No. 620 of 2025 and in view of the petitioner joining on the transferred place of posting, there is no issue regarding any interim order being passed in the present proceedings,

pendency of the writ petition would be futile and serve no purpose.

The learned counsel for the petitioner further submits that since eight weeks, the respondents have not filed any reply before the C.A.T.

The learned counsel representing the respondents submits that he has no instructions in this regard.

In view of the rival submissions, we deem it appropriate that the respondents should ensure filing of the reply before the C.A.T. within two weeks from the date of receipt/production of a copy of this order so as to facilitate consideration of the matter on merits.

We make it clear that we have not made any observations touching upon the merits in the pending matter before the C.A.T.

The Writ Petition being W.P.C.T. 112 of 2025 is dismissed.
