Learned advocate appearing on behalf of the petitioner submits that the private respondents are trying to encroach upon the common passage, ransacked the shop room of the petitioner and the police are not acting on the complaint.

Learned senior standing counsel appearing for the State submits that the complaint of the petitioner was registered as a First Information Report on August 9, 2021 and that the investigation is in progress. As of now, the police learnt that the incident occurred at the instance of the petitioner when the petitioner tried to break open padlock in respect of an adjoining shop room.

Learned advocate appearing for the private respondents submits that there is a civil suit filed at the instance of the petitioner which is pending.

Apparently, there are disputes between private parties relating to an immovable property. The petitioner filed a civil suit which is pending. The petitioner lodged a complaint with regard to an incident which the police are investigating.

In such circumstances, further interference by the writ court is not called for.

WPA 11971 of 2021 is disposed of accordingly.
