The petitioner claims to be the son of a retired employee who was serving in Garden Reach Shipbuilders and Engineers Limited.

Learned advocate for the petitioner submits that there is a circular of the employer published in the year 2008 which mentions about appointment of the heirs of the retired employee.

No such circular of the year 2008 has been annexed to the writ petition. There is no document in support of the aforesaid statement that the heir of a retired employee would be provided a job in the Company.

Learned advocate representing the employer denies existence of any such circular. It has been

specifically submitted that after the employee retires, there is no scope for providing employment to the heirs of the retired employee.

Upon hearing the submissions made on behalf of both the parties and on perusal of the document annexed to the writ petition, it appears that the job of the father of the petitioner was not a heritable one. After retirement of his father, the scope of employment of his father came to an end and there is no provision for providing further employment to the heir of the retired employee.

In view of the above, the prayer of the petitioner for being appointed in the Company cannot be allowed.

The writ petition fails and is hereby dismissed.

All parties shall act on the basis of a server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
